LUMINLAB CREATIVE // TERMS OF SERVICE

These Terms and Conditions govern all transactions for our design services, custom printed products (including t-shirts), and promotional merchandise sold both online and in person. By engaging with our services, you agree to be bound by these Terms. If you disagree with any part, please refrain from using our services.

1. Definitions

- "Business," "We," "Us," "Our" refers to Luminlab Creative. 

- "Client," "Customer," "You" refers to any individual or business purchasing our services or products. 

- "Services" includes graphic design, custom printing, promotional product supply, and related offerings. 

- "Order" means a confirmed request for services or goods. 

- "Artwork" refers to any designs, logos, or images supplied by the client or created by us. 

 

2. Orders & Payments

2.1 Order Acceptance

- Orders are binding once payment (or deposit) is received and confirmed. 

- We reserve the right to reject orders at our discretion. 

 

2.2 Pricing & Payment Terms

- Prices are subject to change without notice. 

- Accepted payment methods: EFT, credit/debit card, or other agreed methods. 

- Full payment is required before production begins, unless a deposit arrangement is agreed upon. 

- Bulk orders (50+ units) may require a 50% non-refundable deposit. 

 

2.3 Refunds, Returns & Cancellations

- Cancellation by Client: If an order is cancelled after production starts, a partial refund may be issued minus material and labour costs. 

- Defective Products: Faulty items must be reported within 5 days of receipt; a replacement or refund will be given upon return of the item.

- Digital Products (Logos/Designs/other): No refunds once files are delivered. 

- Custom-Printed Items: No returns or refunds unless defective (due to our error). 

 

3. Artwork & Intellectual Property

3.1 Client-Supplied Artwork

- You confirm you own or have legal rights to use any submitted artwork. 

- We are not liable for copyright/trademark infringement from client-provided designs. 

 

3.2 Our Original Designs

- We retain copyright on all created designs unless otherwise stipulated. 

- Upon full payment, you receive a non-exclusive license for the agreed use (e.g., printing on merchandise). 

- We may display completed work in our portfolio unless otherwise agreed in writing. 

 

3.3 Design Revisions

- Minor revisions are allowed during the design process (number depends on package). 

- Additional revisions may incur extra fees. 

 

4. Production & Delivery

4.1 Turnaround Times

- Estimated production/delivery times are provided but not guaranteed. 

- Delays from suppliers, couriers, or unforeseen events are not our responsibility. 

 

4.2 Shipping & Collection

- Shipping costs are the client’s responsibility unless otherwise stated. 

- Risk transfers to the client upon delivery/collection. 

- Uncollected orders may incur storage fees after 14 days

 

4.3 Quality Assurance

- Minor color/shade variations may occur due to printing processes. 

- Complaints must be submitted within 5 days of receipt with photo evidence. 

 

5. Promotional Products & Third-Party Items

- We source some products from external suppliers; thus, stock and specs may vary. 

- While we ensure quality, we are not liable for defects in third-party products but will assist to resolve matter. 

 

6. Liability & Indemnification

- Our liability is limited to the order value; we are not responsible for indirect or consequential damages. 

- You agree to indemnify us against claims arising from unauthorized use of supplied artwork. 

 

7. Privacy Policy (POPIA Compliance)

- We comply with South Africa’s Protection of Personal Information Act (POPIA)

- Client data is used only for order processing and will not be sold/shared without consent. 

 

8. Dispute Resolution

- Disputes will first be resolved through good-faith negotiation. 

- If unresolved, the matter may be referred to mediation or small claims court in South Africa. 

 

9. Amendments

- We may update these Terms at any time. Continued use of services constitutes acceptance. 

 

10. Governing Law 

- These Terms are governed by South African law. 

 

By placing an order, you confirm that you have read, understood, and agreed to these Terms.
